European Commission: AI law – first regulations come into force

February 3, 2025. The first provisions of the Artificial Intelligence Act (AI Act) came into force on February 2. These include the definition of AI systems, AI competence and a very limited number of prohibited AI use cases listed in the AI Regulation that pose unacceptable risks in the EU.

Guidelines on the definition of AI systems

In order to facilitate innovation in the field of AI, the Commission will publish guidelines on the definition of AI systems. This is intended to support industry in determining whether a software system is an AI system. The Commission will also publish a live archive of AI competence procedures collected from providers and operators of AI systems. This will promote learning and exchange between them, while ensuring that users develop the skills and knowledge needed to use AI technologies effectively.

Guidelines on prohibited AI practices

To ensure compliance with the AI Act, the Commission will publish guidelines on prohibited AI practices that pose unacceptable risks to the safety and fundamental rights of citizens. These guidelines will explain the legal concepts and provide practical use cases based on stakeholder input. They are non-binding and will be updated as necessary.

Background

The Commission has launched several initiatives to foster AI innovation, from the AI Innovation Package to support start-ups and SMEs to the future AI Factories, which will provide access to the massive computing power that start-ups, industry and researchers need to develop their AI models and systems.
