CONDITIONS OF PARTICIPATION – GENERAL TERMS AND CONDITIONS OF BUSINESS (GTC)

1. Organizer

2. Registration
Registration for participation takes place via the online tool provided for the respective event (e.g. Pretix). The booking must be completed in full. By completing the booking, the participant confirms that he/she is aware of and agrees to the applicable General Terms and Conditions of Participation by actively accepting them by clicking on them. The General Terms and Conditions of Participation apply from the time the booking is completed. When registering, participants are expected to correctly select the participation category that applies to them (e.g. member / non-member). However, Silicon Saxony e.V. will subsequently check the information provided and reserves the right to correct and adjust the selected category accordingly when issuing the invoice.
Registration is possible – depending on the availability of tickets – until the registration deadline specified in the registration form. It is up to the organizer to extend the registration deadline if capacities are not yet exhausted. The registration is considered as an irrevocable and binding contractual relationship between both partners within the scope of the cancellation options.
Silicon Saxony e.V. will confirm admission to the respective event by e-mail.
3. Terms of payment
After registration you will receive an invoice which is due 14 days after receipt. Payments can be made by credit card or bank transfer.
4. Performance and reservation of right of withdrawal
We reserve the right to make changes to the content or timing of the event program and the speakers. We are entitled to withdraw from the contract if an economic realization of the event is not possible due to an insufficient number of exhibitors, sponsors or participants. This also applies in the case of other reasons, apart from those mentioned under 4.a, which do not lie within the area of responsibility of the organizer. In this case we will inform all participants immediately. All payments already made will be refunded immediately. Further claims of the visitors are excluded, unless the organizer is guilty of intent or gross negligence.
4.a Should a restriction be imposed at federal or state level during the event period which makes it impossible to hold the event, the contract shall be subject to the condition subsequent that holding the event one month before its contractually agreed start date would be prohibited due to government measures, such as pandemics.
The decisive factor is the prohibition on holding any events on the above-mentioned cut-off date; it is irrelevant whether the event is feasible on the agreed date [example: the condition subsequent occurs if an event planned for 01.10.2020 could not take place on 01.09.2020 due to a general ruling].
In case of termination of the contract due to the occurrence of the above mentioned condition, Silicon Saxony e. V. receives 15 % of the agreed remuneration as processing fee.
5. Cancellation and rebooking
5.a You can cancel your registration free of charge up to 28 days before the start of the event without giving reasons. Cancellation must be made in writing to the organizer. If the cancellation is made up to 7 days before the start of the event, 50% of the participation fee will be charged as a cancellation fee. In case of later cancellation or non-participation, 100% of the participation fee will be due. Alternatively, the nomination of a substitute person is possible at any time free of charge. Any refunds will be made after the event.
5.b We charge a no-show fee of €69 for no-shows at free events despite binding registration. This does not apply to virtual events and working group events. Cancellation of your registration is only possible for free events up to 24 hours before the start of the event.
6. Pictures and sound recordings
Silicon Saxony e. V. is entitled to have photographs, drawings and film and video recordings made of the event and to use them for advertising or press publications. If the participant does not agree to this, it is possible to express this disagreement in advance of the event. This also applies to press or television recordings with the consent of Silicon Saxony e. V.
Silicon Saxony e. V. must be notified in advance of any press interviews or audio recordings at the event that are initiated by participants themselves.
7. Note on data protection
Participant data (e.g. company name, address, first and last name, title, e-mail address) are processed for the purpose of organizing the event, managing participation and for customer care and information on the basis of Art. 6 para. 1 lit. b and lit. f GDPR.
A list of participants can be created for each event, which may contain the following information: company name, company headquarters (city, country), title and first and last name of the participants.
The forwarding of such a list to other participants as well as to sponsors or exhibitors takes place exclusively on the basis of express consent in accordance with Art. 6 para. 1 lit. a GDPR, which is obtained as part of the registration process.
Any consent given can be revoked at any time with effect for the future. Revocation is possible up to five days before the start of the event at the latest and must be made in writing to the organizer. This does not affect the legality of the processing carried out prior to the revocation.
8. Applicable law / place of jurisdiction
The participation agreement including these GTC is subject to German law with the exception of the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for all claims and legal disputes shall be Dresden if the contractual partner is a merchant, a legal entity under public law or a special fund under public law. In all other respects, the statutory provisions shall apply.
